It has been known that when DOL conducts an audit and the meal break is not on the time card, DOL will believe that employees did not take meal breaks and add 2.5 hours per day of unpaid wages to their hours worked. If the employee worked 40 hours and DOL adds 2.5 hours, then that is 2.5 hours of overtime for every week for every worker unless the employer can prove that the employee did take a meal break.
